NIMIS: LEGACIES BEYOND - TERMS OF SERVICE & CODE OF CONDUCT
Last updated: [date]
Welcome to Nimis: Legacies Beyond. These terms are the agreement between you and us for playing the game. Part One is the terms themselves. Part Two is the Code of Conduct: the rules that keep the Hidden Citadels and the untamed Wilderness engaging, competitive, and safe for all players.
By creating an account and logging into Nimis: Legacies Beyond, you acknowledge that you have read, understood, and agreed to these terms. If you do not agree, do not play. Failure to follow the Code of Conduct will result in administrative action, up to and including permanent account termination.
PART ONE: TERMS OF SERVICE
1. Who we are
Nimis: Legacies Beyond (“the game”) is made and operated by Timeworn Game Works, an independent game studio based in Portugal (“we”, “us”).
- Help with your account or the game: support@playnimis.com
- Your personal data: privacy@playnimis.com
- Reporting an exploit or a cheat privately: security@playnimis.com
How we handle personal data is set out in our Privacy Policy, which is part of this agreement.
2. Who can play
- You must be 16 or older. The game asks for your date of birth when you first start it.
- An account is for one person. You are responsible for everything done with it.
- You must not have been permanently banned from the game.
3. Your account
- You sign in through Steam on PC, and with an account of your own on Android. There is no anonymous play.
- Keep your sign-in details to yourself. We will never ask you for a password.
- Accounts cannot be sold, bought, lent, or shared, including to raise a ranking or to get round a ban. “Someone else was playing on my account” is not a defence.
- You can ask us to delete your account at any time by writing to privacy@playnimis.com. Deletion removes your characters and progress permanently. The Privacy Policy says what is kept and for how long.
4. The game changes, and it can stop
- The game is a live online service in active development. We change it constantly: techniques, numbers, items, maps, and rules are adjusted, added, and removed. Something you earned or bought may be rebalanced.
- During the closed beta, everything is wiped before launch, and may be wiped earlier. The Beta Tester Agreement applies to the beta.
- Characters age, and a rebirth resets them. A character grows older as it is played and in time reaches the end of its natural life. It is never reborn automatically: you choose to rebirth it, or keep it going with Age Freeze Elixirs, which can be earned in play, bought, or passed from another of your characters through the Account Bank. A rebirth resets the character as the game describes. That reset is how the game works, not a fault, and it is not undone or refunded.
- Servers go down for maintenance and sometimes without warning. We do not promise that the game is always available, free of errors, or playable on every device.
- We may stop running the game. If we do, we will give notice in the game and on our website as far ahead as we reasonably can.
5. What you may and may not do with the game
We give you a personal, non-transferable permission to install and play the game for your own enjoyment. We own the game and everything in it.
You may not:
- cheat, or use bots, macros, or any software that plays for you or gives an unfair advantage;
- modify the game client, or use a modified copy. The Android version is only ever available from our official website; any other copy is not ours;
- run, or connect to, a server that is not ours;
- attack, overload, or probe our servers, or try to reach another player’s account or data;
- use the game for any commercial purpose, other than making videos and streams as section 8 allows.
6. Purchases and virtual items
- The only place to pay money for anything in the game is our official store on Steam. Purchases belong to your account and work on every device you play on.
- Virtual items are licensed, not owned. Prisms, gold, items, cosmetics, Trait Jars, and everything else in the game are a permission to use them inside the game. They have no cash value and cannot be redeemed, cashed out, or exchanged for money, by you or by anyone on your behalf.
- Nothing sold has a random result. Every item delivers what its description says. Where chance sits beside a purchase, as with the bonus trait roll every rebirth carries, the odds are shown in the game and on our website.
- Refunds are handled by Steam under Steam’s refund policy. Nothing in these terms limits any right the law gives you as a consumer, including a right of withdrawal where it applies. If a purchase is refunded or charged back, what it bought is removed from the account; if it has already been spent, the account may show a negative balance.
- New accounts cannot trade for a short period after they are created. The trade window says when the restriction ends.
- Prices and what is on sale can change.
7. What you write and name
- You are responsible for your character names, chat messages, and anything else you put into the game. Names that break the Code of Conduct can be changed by us.
- You allow us to show what you write and name to other players, as the game requires, and to keep it for moderation as the Privacy Policy describes.
8. Videos, streams, and our own broadcasts
- You may record, stream, and post footage of the game, and earn from it through the usual features of video and streaming platforms. During the closed beta, the “Closed Beta” mark must stay visible, and the Beta Tester Agreement says when sharing may begin.
- We may broadcast and record play, including yours. We may run an official channel that shows events, challenges, arena battles, and Tension Wars as they happen, and we may use footage and screenshots of play in trailers, on our website, and on our channels. Your character and its name may appear. A masked character stays masked. We do not show chat on a broadcast, and a broadcast runs a short time behind the game.
- You are not paid for appearing in footage, and you do not need to be asked each time.
9. Monitoring
To keep the game fair, we record and review, on the server: chat messages and reports, combat and kill records, trades, and connection data. Game Masters can observe play without being seen. The Privacy Policy lists what is kept and for how long.
10. Our responsibility to you
- The game is provided as it is. We do our best, but we do not promise it will meet your expectations or be free of faults.
- We are not responsible for losses caused by things outside our reasonable control, by your own device or connection, or by another player’s behaviour.
- Nothing in these terms removes or limits any right or remedy that the law says cannot be removed or limited, including your rights as a consumer where you live.
11. Changes to these terms
We may change these terms. When we do, we update the date at the top. For a change that matters, we will tell you in the game before it takes effect and ask you to accept the new terms; if you do not accept, you can stop playing and ask us to delete your account.
12. Ending this agreement
- You can stop at any time by no longer playing, and can ask for your account to be deleted.
- We can suspend or end your access for breaking these terms, as Part Two describes.
13. Law
These terms are governed by the law of Portugal. If you are a consumer living in another country, you also keep the protection of the mandatory consumer laws of that country, and you may bring a claim in your own courts. [To be confirmed with a lawyer, together with any dispute-resolution information Portuguese law requires.]
PART TWO: CODE OF CONDUCT
1. Zero-Tolerance Policies
Certain behaviors are fundamentally incompatible with our community and will result in immediate, severe administrative action. We operate a strict zero-tolerance policy against the following:
- Hate Speech & Discrimination: Any language, imagery, or behavior that promotes discrimination, hatred, or violence against individuals or groups based on race, ethnicity, national origin, religion, gender identity, sexual orientation, age, or disability is strictly prohibited. Racism and bigotry have no place in this game.
- Real-World Threats: Making threats of physical harm, violence, or swatting against another player, Game Master (GM), or developer is a severe violation.
- Doxxing & Privacy Violations: Sharing, threatening to share, or requesting the real-world personal information (names, addresses, phone numbers, social media profiles) of another player is strictly forbidden.
- Real Money Trading (RMT): The buying, selling, or trading of accounts, characters, gold, in-game items, Trait Jars, Prisms, or any other in-game asset for real-world currency, for anything of value outside the game, or for out-of-game services is strictly prohibited and will result in an instant ban. This applies to the buyer and to the seller alike, and to anyone who advertises or arranges such a sale.
- The only way to pay money for anything in the game is our official store on Steam. Any website, person or service offering Prisms, gold, items, Trait Jars, accounts or boosting for money is not us and is not permitted.
- Trading inside the game is allowed. Exchanging gold, Prisms, tradeable items and Trait Jars with another player through the in-game trade window is a normal part of the game. What is prohibited is anything that leaves the game on either side of the deal.
- Prisms and everything else in the game have no cash value. They cannot be redeemed, refunded by us, or exchanged for money, by you or by anyone on your behalf.
- What was obtained through RMT is removed, from every account it reached, and those accounts are subject to the same ban.
2. General Code of Conduct
While Nimis: Legacies Beyond features high-stakes, open-world PvP and competitive banter is a natural part of the game, there is a clear line between competition and toxicity.
- Toxic Communication & Harassment: Excessive use of profanity, slurs, or highly aggressive language designed to insult or demean others is prohibited. Harassing or degrading a specific player across multiple chat channels goes beyond standard PvP rivalry.
- Chat Spamming: Flooding Say, Citadel, Global, or OOC chat channels with repetitive messages, symbols, or advertisements is not allowed. Keep communication legible and respectful of others’ screens.
- Staff Impersonation: Pretending to be a Game Master, Server Administrator, or developer to threaten, scam, or extract information from other players is strictly forbidden.
- Account Sharing & Selling: You are entirely responsible for all actions taken on your account. Selling your account, or sharing it with others to boost rankings or bypass bans, is prohibited. “Someone else was playing on my account” will not be accepted as a valid defense for broken rules.
3. PvP Integrity & Gameplay Mechanics
To maintain a balanced and competitive open world, players must engage with the game’s systems as intended.
- Stat Padding & Alt-Killing: Repeatedly killing your own alternate characters, or collaborating with party members, faction members, or enemy players to artificially farm Nimian Points, ranks, or achievements is considered exploiting. Be advised: our servers keep kill records and connection data, and we use them to detect and verify artificial stat padding.
- Corpse Camping & Griefing: While open-world PvP means you can be attacked at any time, spam killing the same player over and over (e.g., camping a spawn point for an extended period without allowing the player to escape or play) with the explicit intent of preventing them from playing the game is considered griefing.
- Bug Abuse & Exploitation: Utilizing third-party software (cheats/macros) or deliberately abusing known in-game bugs to gain an unfair advantage is strictly forbidden. If you discover a bug or exploit, you must report it immediately, privately, to security@playnimis.com or a Game Master. Abusing it instead of reporting it will result in severe penalties.
- Safe Zone & Mechanic Abuse: Using your character to intentionally block access to vendors, critical NPCs, or the entrances/exits of the Hidden Citadels is prohibited. This includes exploiting zone-transition invincibility frames or character collision mechanics to troll other players.
4. Disciplinary Actions & The Escalation System
Our Game Masters (GMs) and Server Administrators actively monitor the game and possess a robust suite of server-side tools to enforce these rules. Disciplinary actions are applied at the discretion of the Administration team.
- First-Time & Minor Offenses: Players who commit minor infractions may receive a temporary penalty as a warning. This can include immediate Kicks (forced disconnections) or temporary Mutes (complete revocation of all chat channel privileges for a set duration, applied without public notification).
- Temporary Bans: Moderate offenses or repeated minor infractions will result in temporary account suspensions, preventing you from logging into the server for a specified number of days.
- Permanent Bans: Severe violations (such as RMT, staff impersonation, racism, doxxing, or extreme harassment), or a history of repeated toxic behavior, will result in a Permanent Ban of your account. Returning on another account is ban evasion, and that account is banned too. We keep a record of a permanent ban, as the Privacy Policy describes, so that it cannot be evaded.
5. Financial Investment & Account Termination
Nimis: Legacies Beyond strictly enforces equality in its disciplinary system. Financial investment does not grant immunity from the rules.
- No Premium Protection: Purchasing Prisms, cosmetic items, or maintaining an active Vanguard Covenant Subscription does not protect you from Mutes, Kicks, Temporary Bans, or Permanent Bans. All players are held to the exact same behavioral standards.
- Forfeiture of Purchases: If your account is permanently banned for violating this Code of Conduct, you lose access to all characters, progress, accumulated Prisms, and active subscriptions. We do not refund purchases on an account terminated for a breach of these terms. Refunds are otherwise handled by Steam under its refund policy, and nothing here limits a right the law gives you as a consumer.
6. Administrative Authority
- Decisions and review: Server Administrators and GMs decide mutes, bans, and other disciplinary actions. If you believe a ban was a mistake, you may ask once for it to be reviewed by writing to support@playnimis.com within 30 days, from the email address linked to your account. The outcome of that review is final.
- Investigation & Monitoring: GMs possess the tools to investigate reports invisibly and monitor chat logs, kill records, and player actions server-side to verify claims of toxic behavior or exploitation. Attempts to evade administrative action or retaliate against players who report rule-breaking will result in an immediate Permanent Ban.
